The Massachusetts Contingency Plan or MCP regulations are designed to protect the environment and the health and safety of the people of Massachusetts. Our MCP consulting services address all of the various MCP requirements that apply whenever there has been a release of oil and/or hazardous materials (OHM). These services may include soil and groundwater sampling to assess the source, nature, and extent of contamination; a human health and ecological risk assessment; a feasibility evaluation of remedial alternatives; and remedial design, operation, and maintenance of an appropriate solution to remedy the release. So whether you need a RNF, an LRA, an AUL, a RAM or URAM, an IRA, or an RAO, we are able to meet your needs.

Licensed Site Professional (LSP) Services

Massachusetts requires the use of a Licensed Site Professional, or LSP, to oversee and "sign off" on most activities related to the assessment and cleanup of waste sites in the state. LSPs are authorized by the Commonwealth to manage the assessment and cleanup process. We provide "LSP of Record" services as a normal part of our consulting practice and maintain current certification by completing continuing education on an ongoing basis.

Real Estate Development

For any commercial property, whether refinancing, leasing, or purchasing, a current environmental site assessment normally is required; checking out the environmental condition ahead of time also makes sound business sense. Cooperstown Environmental commonly works with developers and other clients to submit ASTM–compliant Phase I and Phase II Environmental Site Assessments or Transaction Screens in a timely manner. Should the due diligence indicate the need for additional work, we are qualified to continue whatever work that may be required.

SPCC Plan

EPA requires a Spill Prevention, Control, and Countermeasure (SPCC) Plan for most businesses who have combined, above ground storage of 1,320 gallons or more of any type of oil. This storage includes drums, tanks, and even vehicles. The SPCC is intended to avoid oil spills and prevent an oil release from reaching a water body. The SPCC must be prepared in accordance with the EPA requirements and signed by a Registered Professional Engineer. 

Due Diligence (21E)

In Massachusetts, an Environmental Site Assessment (ESA) is often referred to as a "21E" after the Chapter in the Massachusetts General Laws (M.G.L.) which addresses the "Oil and Hazardous Material Release Prevention and Response Act". This law requires that property owners report and address with any contamination found on a property prior to its sale, and that the potential buyers are aware of any releases on the property. Users of these 21E site assessments are said to be performing their "due diligence" with respect to investigating the background of the site. NPDES Permit Assistance

The National Pollutant Discharge Elimination System, or NPDES, was introduced in 1972 as part of the original Clean Water Act to control water pollution by regulating point sources that discharge pollutants into the waters of the United States. EPA regulates such discharges by issuing permits to parties who desire to make a discharge to surface water; often the permit applications are extensive and require testing and engineering for their completion. Often, such discharges are the result of a temporary or ongoing dewatering or treatment system and testing is required throughout the discharge to ensure that the treatment system is operating effectively. A Remediation General Permit (RGP) or Stormwater General Permit may be used to streamline the process

Litigation Support /
Expert Witness Service

Cooperstown Environmental LLC can provide experts to assist with ongoing litigation up to and including depositions and court testimony. We have worked successfully on behalf of the Massachusetts Office of the Attorney General in defending the state against a construction claim; have worked on a large claim against an insurance company for a PRP seeking coverage under an old property insurance policy; and worked on behalf of an insurance company in a subrogation case. Stormwater Services

Cooperstown Environmental LLC can provide a variety of storm water management services from inspection, maintenance, and reporting services for storm water management facilities to more comprehensive services including the preparation of a Stormwater Pollution Prevention Plan (SWPPP), drainage reports, permit assistance, and related services related to system operations and maintenance as well as during construction.

Toxic Use Reduction Plans

Cooperstown Environmental LLC provides services to companies that are covered by the Massachusetts Toxic Use Reduction Act, which is intended to promote safer and cleaner production by reducing the use of toxic materials. Our staff includes a certified Toxic Use Reduction Planner, or TURP. The preparation of a TURA Plan, which must be signed by a TURP, and the filing of a Form S are required for users who exceed certain thresholds for chemical use set forth under TURA.

EHS Training

Cooperstown Environmental LLC has provided training in a variety of topics including SPCC training, awareness training for hazardous waste operations, RCRA training, Environmental Management System-related training, and other topics related to environmental regulations. Our history includes several training sessions for aspiring and current LSPs on the specifics related to the MCP. 

Public Sector Engineering

Cooperstown Environmental LLC has extensive experience in providing engineering assistance to municipalities and public agencies from conceptual design, through design development, to final design including the production of plans and specifications for public bidding. We have conducted public bids, developed engineering cost estimates, and provided construction administration services including construction observation to ensure conformance with the Engineer's design plans. Underground Storage Tanks (USTs)
